Upon filing Chapter 13, the automatic stay stops all collection efforts including foreclosure, repossession and lawsuits.  If your plan is approved, payments are made to a court appointed trustee who deals with your creditors.  Creditors are forced to accept payments set by the Chapter 13 plan.


Monthly payments are calculated based upon several factors, including the amount of your income and debts and the value of your assets.


The rules are complicated as to who qualifies for Chapter 13.  It offers the opportunity to save your house and car from foreclosure and repossession.  A Chapter 13 payment plan, ranging between 3 and 5 years, offering a fresh start.
